Because many of our products include fresh flowers, plants, bouquets, floral arrangements and other natural or seasonal materials, variations in color, size, shape, bloom stage, texture and overall appearance may naturally occur. Product images are for illustrative purposes and the final product may vary reasonably from the image displayed.

Availability of specific flowers, varieties, colors and seasonal materials may change according to season, stock and supplier availability. Where necessary, White Lotus may substitute a flower or component with another of a similar style, character or value, while making reasonable efforts to preserve the overall design, color palette and value of the ordered product.

We do not warrant that the appearance or quality of any products or services purchased by you will be identical to those depicted or rendered in our online store.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

When you place an order, you are making an offer to purchase. White Lotus reserves the right to accept or decline your order for any reason at its discretion, subject to applicable law.

Your order is not accepted until White Lotus confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as White Lotus may be unable to accommodate cancellation requests after an order is accepted, particularly where preparation, floral arrangement, customization or dispatch has already begun.

In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address, billing details and/or phone number provided at the time the order was made.

Your purchases are subject to return, cancellation or exchange solely in accordance with our Refund Policy and applicable law.

You represent and warrant that your purchases are for your own personal or household use and not for unauthorized commercial resale or export.

Prices, discounts and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation.

Unless otherwise expressly stated, posted prices do not include shipping, handling or other additional charges that may apply and be displayed during checkout.

Prices posted in our online store may be different from prices offered in our physical store or through other sales channels, subject to applicable law.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery are provided in accordance with our Shipping Policy.

White Lotus currently provides delivery services within supported areas in central Israel, the Sharon region and the Shfela region, subject to availability and the specific delivery address.

Delivery options may include expedited delivery of up to 4 hours, subject to the applicable terms, order time, business hours, product availability, delivery address, courier availability and operational capacity.

Future delivery orders may allow customers to select an available delivery time window, including:

10:00–13:00
13:00–16:00
16:00–19:00

All delivery times and delivery windows are estimates unless expressly stated otherwise and are subject to the terms of our Shipping Policy.

We make reasonable efforts to meet estimated delivery times. However, delays may occur due to traffic, road closures, weather conditions, holidays, peak demand, security situations, governmental instructions, courier availability, force majeure or other events outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information. If an incorrect or incomplete address is provided, or if delivery cannot be completed due to circumstances attributable to the customer or recipient, an additional delivery charge may apply.

WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT OR REMEDY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHITE LOTUS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED THROUGH THE SERVICES, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

THIS MAY INCLUDE, WITHOUT LIMITATION AND WHERE PERMITTED BY LAW, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR SIMILAR DAMAGES.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY WHERE SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY APPLICABLE LAW.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless White Lotus, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or claims, including reasonable legal fees, payable to a third party due to or arising out of:

אנו שומרים לעצמנו את הזכות להפסיק להציע מוצר מסוים בכל עת וכן להגביל את כמויות המוצרים המוצעים לאדם, לאזור גאוגרפי או לתחום שיפוט מסוים, לפי העניין.

סעיף 3 – הזמנות

בעת ביצוע הזמנה אתם מגישים הצעה לרכישה.

White Lotus שומרת לעצמה את הזכות לקבל או לדחות הזמנה מכל סיבה סבירה ובהתאם לשיקול דעתה, בכפוף להוראות הדין החל.

הזמנה לא תיחשב כמאושרת עד ש־White Lotus תאשר את קבלתה. עלינו לקבל ולעבד את התשלום לפני אישור ההזמנה.

אנא בדקו היטב את פרטי ההזמנה לפני שליחתה, שכן ייתכן ש־White Lotus לא תוכל להיענות לבקשות ביטול לאחר שההזמנה התקבלה ואושרה, במיוחד כאשר כבר החלה הכנת ההזמנה, שזירת הפרחים, עיצוב הסידור, התאמה אישית או הוצאת ההזמנה למשלוח.

במקרה שבו לא נקבל הזמנה, נבצע שינוי בהזמנה או נבטל אותה, ננסה להודיע לכם באמצעות כתובת הדוא"ל, פרטי החיוב ו/או מספר הטלפון שנמסרו בעת ביצוע ההזמנה.

רכישות כפופות למדיניות ההחזרים, הביטולים וההחלפות שלנו ולהוראות הדין החל.

אתם מצהירים ומתחייבים כי הרכישות מיועדות לשימוש אישי או ביתי ולא למכירה מסחרית חוזרת בלתי מורשית או לייצוא בלתי מורשה.

סעיף 4 – מחירים וחיוב

מחירים, הנחות ומבצעים עשויים להשתנות ללא הודעה מוקדמת, בכפוף לדין החל.

המחיר שייגבה עבור מוצר או שירות יהיה המחיר התקף בעת ביצוע ההזמנה, כפי שיופיע באישור ההזמנה.

אלא אם צוין במפורש אחרת, המחירים המפורסמים אינם כוללים דמי משלוח, טיפול או חיובים נוספים שעשויים לחול ולהיות מוצגים במהלך תהליך התשלום.

המחירים המפורסמים בחנות המקוונת עשויים להיות שונים מהמחירים המוצעים בחנות הפיזית או בערוצי מכירה אחרים, בכפוף לדין החל.

מעת לעת אנו עשויים להציע מבצעים במסגרת השירותים, אשר עשויים להשפיע על המחירים ולהיות כפופים לתנאים נפרדים מתנאים אלה.

במקרה של סתירה בין תנאי מבצע מסוים לבין תנאים אלה, תנאי המבצע יחולו ביחס לאותו מבצע.

אתם מתחייבים למסור מידע עדכני, מלא ומדויק בנוגע לרכישה, לתשלום ולחשבון עבור כל רכישה המבוצעת בחנות.

אתם מתחייבים לעדכן ללא דיחוי מידע רלוונטי, לרבות כתובת דוא"ל ופרטי תשלום, כדי שנוכל להשלים עסקאות וליצור עמכם קשר לפי הצורך.

אתם מצהירים ומתחייבים כי:

(א) פרטי התשלום שמסרתם נכונים, מדויקים ומלאים;

(ב) אתם מורשים כדין להשתמש באמצעי התשלום לצורך הרכישה;

(ג) החיובים יאושרו ויכובדו על ידי ספק התשלום הרלוונטי;

(ד) תשלמו את הסכומים החלים בהתאם למחירים המוצגים, לרבות דמי משלוח ומסים, ככל שחלים.

סעיף 5 – משלוחים ואספקה

המשלוחים והאספקה מתבצעים בהתאם למדיניות המשלוחים שלנו.

White Lotus מספקת כיום שירותי משלוח באזורים נתמכים במרכז הארץ, באזור השרון ובאזור השפלה, בכפוף לזמינות ולכתובת המשלוח המדויקת.

אפשרויות המשלוח עשויות לכלול משלוח מהיר בתוך עד 4 שעות, בכפוף לתנאים הרלוונטיים, שעת ביצוע ההזמנה, שעות פעילות העסק, זמינות המוצרים והפרחים, כתובת המשלוח, זמינות שליחים והיכולת התפעולית.

בהזמנות למשלוח עתידי, ניתן לבחור, בהתאם לזמינות, אחד מחלונות הזמן הבאים:

10:00–13:00
13:00–16:00
16:00–19:00

כל זמני המשלוח וחלונות המסירה הם משוערים, אלא אם צוין במפורש אחרת, וכפופים למדיניות המשלוחים שלנו.

אנו עושים מאמצים סבירים לעמוד בזמני המשלוח המשוערים. עם זאת, עיכובים עשויים להתרחש עקב עומסי תנועה, חסימות כבישים, תנאי מזג אוויר, חגים, עומסי ביקוש, מצב ביטחוני, הנחיות רשויות, זמינות שליחים, כוח עליון או אירועים אחרים שאינם בשליטתנו הסבירה.

באחריות הלקוחות למסור פרטי משלוח מלאים ומדויקים.

אם נמסרה כתובת שגויה או חלקית, או אם לא ניתן להשלים את המסירה בשל נסיבות התלויות בלקוח או בנמען, ייתכן שיחול חיוב נוסף בגין משלוח נוסף.

לפרטים מלאים יש לעיין במדיניות המשלוחים שלנו.

סעיף 6 – קניין רוחני

השירותים שלנו, לרבות אך לא רק סימני מסחר, מותגים, טקסטים, תצוגות, תמונות, גרפיקה, ביקורות מוצרים, סרטונים, קובצי שמע, וכן העיצוב, הבחירה והסידור שלהם, הם בבעלות White Lotus, החברות הקשורות אליה או מעניקי הרישיון שלה, ומוגנים בהתאם לדיני הקניין הרוחני החלים.

תנאים אלה מתירים לכם להשתמש בשירותים לצרכים אישיים ולא־מסחריים בלבד.

אין לשכפל, להפיץ, לשנות, ליצור יצירות נגזרות, להציג בפומבי, לבצע בפומבי, לפרסם מחדש, להוריד, לאחסן או להעביר חומר כלשהו מהשירותים ללא הסכמתנו מראש ובכתב, למעט כפי שמותר על פי הדין החל.

אלא אם נקבע במפורש אחרת, אין בתנאים אלה כדי להעניק או להתפרש כמעניקים רישיון או זכות אחרת מכוח פטנט, סימן מסחר, זכות יוצרים או זכות קניין רוחני אחרת של White Lotus, Shopify או צד שלישי כלשהו.

שימוש בלתי מורשה בשירותים עשוי להוות הפרה של דיני הקניין הרוחני החלים.

כל הזכויות שלא הוענקו במפורש שמורות ל־White Lotus.

שמות White Lotus, סמלי הלוגו, שמות המוצרים והשירותים, העיצובים והסיסמאות הם סימני מסחר או נכסים קנייניים אחרים של White Lotus, החברות הקשורות אליה או מעניקי הרישיון שלה, ואין להשתמש בהם ללא אישור מראש ובכתב.

שמה, סמלה, שמות מוצריה ושירותיה, עיצוביה וסיסמאותיה של Shopify הם סימני מסחר של Shopify.

כל יתר השמות, סמלי הלוגו, שמות המוצרים והשירותים, העיצובים והסיסמאות המופיעים בשירותים הם סימני המסחר של בעליהם בהתאמה.

סעיף 7 – כלים אופציונליים

ייתכן שתינתן לכם גישה לכלים המוצעים על ידי צדדים שלישיים כחלק מהשירותים, אשר איננו מפקחים עליהם ואין לנו שליטה או השפעה עליהם.

אתם מאשרים ומסכימים כי הגישה לכלים אלה ניתנת "כפי שהם" ו"כפי שהם זמינים", ללא אחריות, מצג או תנאי מכל סוג וללא תמיכה או אישור מצדנו.

לא תהיה לנו אחריות הנובעת מהשימוש שלכם בכלים אופציונליים של צדדים שלישיים, במידה המרבית המותרת לפי הדין החל.

כל שימוש בכלים אופציונליים המוצעים דרך האתר נעשה לפי שיקול דעתכם ועל אחריותכם, ועליכם לוודא שאתם מכירים ומאשרים את התנאים שבהם הכלים מסופקים על ידי ספקי הצד השלישי הרלוונטיים.

בעתיד אנו עשויים להציע תכונות חדשות באמצעות השירותים, לרבות כלים ומשאבים חדשים. תכונות אלה ייחשבו אף הן כחלק מהשירותים ויהיו כפופות לתנאי שירות אלה.

סעיף 8 – קישורים לצדדים שלישיים

השירותים עשויים לכלול חומרים וקישורים לאתרים המסופקים או מופעלים על ידי צדדים שלישיים, לרבות פונקציות משובצות של צדדים שלישיים.

איננו אחראים לבדיקה או להערכה של תוכן או דיוק של חומרים או אתרים של צדדים שלישיים שבהם תבחרו לבקר.

אם תחליטו לעזוב את השירותים ולגשת לחומרים או לאתרים של צדדים שלישיים, אתם עושים זאת על אחריותכם.

במידה המרבית המותרת לפי הדין החל, איננו אחראים לנזק הקשור לגישה לאתרי צד שלישי או לרכישה או שימוש במוצרים, שירותים, משאבים או תוכן באתרים אלה.

יש לעיין בקפידה במדיניות ובנהלים של הצד השלישי ולוודא שהבנתם אותם לפני ביצוע עסקה.

תלונות, תביעות, חששות או שאלות הנוגעים למוצרים ולשירותים של צד שלישי יש להפנות לצד השלישי הרלוונטי.

סעיף 9 – הקשר עם Shopify

White Lotus פועלת באמצעות Shopify, המאפשרת לנו לספק לכם את השירותים.

עם זאת, כל מכירה ורכישה המתבצעת בחנות שלנו נעשית ישירות מול White Lotus.

בעצם השימוש בשירותים אתם מאשרים ומסכימים כי Shopify אינה המוכרת של המוצרים הנרכשים ישירות מ־White Lotus ואינה אחראית לקיום עסקאות המכירה ביניכם לבין White Lotus, למעט ככל שנדרש אחרת על פי הדין החל.

במידה המרבית המותרת לפי הדין החל, אתם משחררים את Shopify ואת החברות הקשורות אליה מתביעות, נזקים והתחייבויות הנובעים אך ורק מרכישות ועסקאות שביצעתם מול White Lotus.

סעיף 10 – מדיניות פרטיות

כל מידע אישי שאנו אוספים באמצעות השירותים כפוף למדיניות הפרטיות שלנו, ומידע אישי מסוים עשוי להיות כפוף גם למדיניות הפרטיות של Shopify.

בעצם השימוש בשירותים אתם מאשרים כי ניתנה לכם האפשרות לעיין במדיניות הפרטיות הרלוונטית.

מאחר שהשירותים מתארחים באמצעות Shopify, Shopify עשויה לאסוף ולעבד מידע אישי הנוגע לגישה שלכם לשירותים ולשימוש בהם, לצורך אספקת השירותים, אבטחתם ושיפורם.

מידע שתמסרו לשירותים עשוי להיות מועבר ומשותף עם Shopify ועם ספקי שירות צד שלישי רלוונטיים, אשר עשויים להימצא במדינות אחרות ממדינת מגוריכם, בכפוף לדין החל ולנהלי הפרטיות הרלוונטיים.

למידע נוסף על האופן שבו White Lotus וספקי שירות רלוונטיים מעבדים מידע אישי, יש לעיין במדיניות הפרטיות שלנו.

סעיף 11 – משוב ותוכן שנמסר על ידי משתמשים

אם תמסרו, תעלו, תפרסמו, תשלחו בדוא"ל או תעבירו בדרך אחרת רעיונות, הצעות, משוב, ביקורות, הצעות עסקיות, תוכניות או תוכן אחר כלשהו (להלן יחד: "משוב"), אתם מעניקים לנו רישיון תמידי, כלל־עולמי, ניתן לרישוי משנה וללא תמלוגים, להשתמש, לשכפל, לשנות, לפרסם, להפיץ ולהציג את המשוב בכל אמצעי ולכל מטרה חוקית, לרבות שימוש מסחרי, בכפוף לדין החל.

אנו עשויים, לדוגמה, להשתמש בזכויות מכוח רישיון זה לצורך הפעלה, אספקה, הערכה, שיפור וקידום של השירותים וכן לצורך ביצוע התחייבויותינו ומימוש זכויותינו לפי תנאי שירות אלה.

אתם מצהירים ומתחייבים כי:

(א) אתם הבעלים של המשוב או מחזיקים בכל הזכויות הנדרשות בו;

(ב) גיליתם כל תמורה או תמריץ שקיבלתם בקשר למסירת המשוב;

(ג) המשוב עומד בתנאים אלה.

איננו מחויבים:

(1) לשמור על סודיות המשוב, למעט כאשר הדבר נדרש לפי דין;

(2) לשלם תמורה בגין המשוב;

(3) להשיב למשוב.

אנו רשאים, אך איננו מחויבים, לנטר, לערוך או להסיר משוב שלפי שיקול דעתנו הוא בלתי חוקי, פוגעני, מאיים, משמיץ, פורנוגרפי, מגונה, בלתי ראוי באופן אחר, מפר זכויות קניין רוחני או מפר תנאים אלה.

אתם מסכימים כי המשוב שלכם לא יפר זכות של צד שלישי, לרבות זכויות יוצרים, סימני מסחר, פרטיות, זכויות אישיות או זכויות קנייניות אחרות.

כמו כן, המשוב לא יכלול תוכן בלתי חוקי, פוגעני או מגונה, ולא יכלול וירוסים, תוכנות זדוניות או קוד העלול להשפיע על פעולת השירותים או אתר קשור.

אין להשתמש בכתובת דוא"ל כוזבת, להתחזות לאדם אחר או להטעות אותנו או צדדים שלישיים באשר למקור המשוב.

אתם האחראים הבלעדיים למשוב שאתם מוסרים ולדיוקו. במידה המרבית המותרת לפי דין, איננו נושאים באחריות למשוב שפורסם על ידכם או על ידי צד שלישי.

סעיף 12 – שגיאות, אי־דיוקים והשמטות

מעת לעת עשוי להופיע בשירותים מידע הכולל טעויות דפוס, אי־דיוקים או השמטות, לרבות בנוגע לתיאורי מוצרים, מחירים, מבצעים, הצעות, עלויות משלוח, זמני מסירה וזמינות.

אנו שומרים לעצמנו את הזכות לתקן טעויות, אי־דיוקים או השמטות, ולשנות או לעדכן מידע או לבטל הזמנות אם מידע מסוים שגוי באופן מהותי, בכפוף לדין החל.

ככל שהדבר סביר ונדרש, ננסה להודיע ללקוחות שנפגעו משינויים מהותיים הנוגעים להזמנותיהם.

סעיף 13 – שימושים אסורים

ניתן לגשת לשירותים ולעשות בהם שימוש למטרות חוקיות בלבד.

אין לגשת לשירותים או להשתמש בהם, במישרין או בעקיפין:

(א) למטרה בלתי חוקית או זדונית;

(ב) לצורך הפרת דין, תקנה או דרישה חוקית החלים ברמה בינלאומית, לאומית או מקומית;

(ג) לצורך הפרת זכויות הקניין הרוחני שלנו או של אחרים;

(ד) לצורך הטרדה, התעללות, השפלה, פגיעה, השמצה, ביזוי או הפחדה של עובדינו או של אדם אחר;

(ה) לצורך העברת מידע כוזב או מטעה;

(ו) לצורך שליחה, קבלה ביודעין, העלאה, הורדה, שימוש או שימוש חוזר בחומר שאינו עומד בתנאים אלה;

(ז) לצורך משלוח או גרימת משלוח של חומר פרסומי או שיווקי בלתי מורשה, לרבות דואר זבל, הודעות שרשרת, ספאם או פניות דומות;

(ח) לצורך התחזות או ניסיון התחזות לאדם או לישות אחרת;

(ט) לצורך התנהגות המגבילה או פוגעת בשימוש או בהנאה של אדם אחר מהשירותים, או העלולה לפגוע ב־White Lotus, ב־Shopify או במשתמשי השירותים, או לחשוף אותם לאחריות.

בנוסף, אתם מסכימים שלא:

(א) להעלות או להעביר וירוסים או קוד זדוני אחר העלול להשפיע על פעולת השירותים;

(ב) לשכפל, להעתיק, לחלץ, למכור, למכור מחדש או לנצל חלק מהשירותים ללא הרשאה;

(ג) לאסוף או לעקוב שלא כדין אחר מידע אישי של אחרים;

(ד) לבצע ספאם, פישינג, פארמינג או פעילות מטעה אחרת;

(ה) להשתמש ברובוטים, עכבישי רשת, כלי גירוד נתונים, כלי איסוף וחילוץ מידע, התקנים או תהליכים אוטומטיים, כלי בינה מלאכותית או אמצעים אוטומטיים או ידניים לצורך גישה לשירותים בניגוד לתנאים אלה או לדין החל;

(ו) להפריע, לעקוף או לסכל מאפייני אבטחה או הרשאה או אמצעים אחרים שנועדו להגביל גישה לשירותים.

אנו שומרים לעצמנו את הזכות להשעות, להשבית או לסיים את חשבונכם או את גישתכם לשירותים אם נקבע באופן סביר כי הפרתם תנאים אלה, בכפוף לדין החל.

סעיף 14 – סוכנים אוטומטיים

14.1 סעיף זה ("תנאי הסוכנים") חל אם אתם משתמשים, מאפשרים, מפעילים או גורמים להפעלת "סוכן" לצורך גישה, שימוש או אינטראקציה עם השירותים.

"סוכן" פירושו תוכנה או שירות המבצעים פעולה אוטונומית או אוטונומית־למחצה בשם אדם או ישות, או לפי הוראותיהם, ואשר יכולים לפעול בשם אדם או באמצעות מכשירו ללא פיקוח ישיר.

14.2 סוכן אינו רשאי לגשת לשירותים, להשתמש בהם או לקיים עמם אינטראקציה אלא אם הוא מזהה את עצמו בכל עת ופועל בהתאם לדרישות סעיף 14.4 להלן.

בנוסף, סוכן אינו רשאי לגשת לשירותים, להשתמש בהם או לקיים עמם אינטראקציה אם ביקשנו ממנו להימנע מכך.

14.3 אנו רשאים להגביל, לרבות באמצעים טכניים, האם וכיצד סוכן ניגש לשירותים, משתמש בהם או מקיים עמם אינטראקציה.

14.4 סוכנים חייבים:

(א) בכל בקשת HTTP/HTTPS, לזהות כי הבקשה מגיעה מסוכן ולגלות את שם הסוכן באמצעות הכללת הנוסח הבא במחרוזת ה־User Agent:
"Agent/[agent name]";

(ב) לא להסתיר או לטשטש את העובדה שהגישה, השימוש או האינטראקציה מבוצעים על ידי סוכן, לרבות באמצעות חיקוי התנהגות אנושית או עקיפת CAPTCHA או אמצעים דומים;

(ג) להשיב אמת לכל שאלה או בקשה שמטרתה לברר אם האינטראקציה מגיעה מאדם או ממחשב;

(ד) לא לעקוף אמצעים שנועדו לחסום, להגביל, לשנות או לשלוט באופן שבו סוכנים ניגשים לשירותים או משתמשים בהם.

סעיף 15 – סיום

אנו רשאים לסיים הסכם זה או את גישתכם לשירותים, כולם או חלקם, כאשר הדבר מותר לפי הדין החל, לרבות במקרה של הפרת תנאים אלה.

אתם תישארו אחראים לכל סכום המגיע כדין עד למועד הסיום.

הסעיפים הבאים ימשיכו לחול לאחר סיום, ככל שהדבר נובע מטבעם: קניין רוחני, משוב, סיום, הסתייגות מאחריות, הגבלת אחריות, שיפוי, הפרדת הוראות, ויתור והסכם מלא, המחאה, דין חל, מדיניות פרטיות וכל הוראה אחרת שמטבעה נועדה להמשיך לחול.

סעיף 16 – הסתייגות מאחריות

המידע המוצג בשירותים או באמצעותם נמסר למטרות מידע כלליות.

איננו מתחייבים לדיוקו, שלמותו או שימושיותו של מידע זה, למעט מקום שבו חובה כאמור חלה עלינו לפי דין.

כל הסתמכות על מידע כאמור נעשית על אחריות המשתמש, בכפוף לזכויות שלא ניתן לשלול לפי דין.

למעט כפי שנקבע במפורש על ידי White Lotus או כנדרש לפי דין, השירותים והמוצרים המוצעים באמצעותם מסופקים "כפי שהם" ו"כפי שהם זמינים", ללא מצגים, אחריות או תנאים מכל סוג, מפורשים או משתמעים, במידה המרבית המותרת לפי דין.

איננו מתחייבים כי השימוש בשירותים יהיה רציף, זמין במועד מסוים, מאובטח או נקי משגיאות.

אין בתנאים אלה כדי לשלול או להגביל אחריות, זכות או סעד שלא ניתן לשלול או להגביל לפי הדין החל.

סעיף 17 – הגבלת אחריות

במידה המרבית המותרת לפי הדין החל, White Lotus, שותפיה, מנהליה, נושאי המשרה בה, עובדיה, חברות קשורות, סוכנים, קבלנים, ספקי שירות או מעניקי רישיון, וכן Shopify והחברות הקשורות אליה, לא יישאו באחריות לנזקים עקיפים, מקריים, עונשיים, מיוחדים או תוצאתיים הנובעים מהשימוש בשירותים או במוצרים שנרכשו באמצעותם, למעט מקום שבו לא ניתן לשלול או להגביל אחריות כאמור לפי דין.

נזקים כאמור עשויים לכלול, ככל שמותר לפי דין, אובדן רווחים, אובדן הכנסות, אובדן חיסכון, אובדן נתונים או נזקים דומים.

אין בתנאים אלה כדי לשלול או להגביל אחריות כאשר שלילה או הגבלה כאמור אסורות לפי הדין החל.

סעיף 18 – שיפוי

במידה המותרת לפי הדין החל, אתם מסכימים לשפות, להגן ולפטור מאחריות את White Lotus, Shopify, החברות הקשורות אלינו, שותפים, נושאי משרה, מנהלים, עובדים, סוכנים, קבלנים, מעניקי רישיון וספקי שירות, בגין הפסדים, נזקים, התחייבויות או תביעות, לרבות הוצאות משפטיות סבירות, המגיעים לצד שלישי עקב או הנובעים מ:

(1) הפרה מהותית שלכם של תנאי שירות אלה או מסמכים המשולבים בהם בהפניה;

(2) הפרת דין או זכויות של צד שלישי;

(3) גישה או שימוש בלתי חוקיים או בלתי מורשים בשירותים.

ככל שניתן, נמסור הודעה סבירה על תביעה הניתנת לשיפוי. אי־מסירת הודעה מיידית לא תפטור אתכם מהתחייבויותיכם אלא אם נגרם לכם נזק מהותי עקב כך.

אנו רשאים לנהל את ההגנה והפשרה בתביעה כאמור, לרבות בחירת ייעוץ משפטי, בכפוף לדין החל.

לא נסכים לפשרה המטילה עליכם התחייבות שאינה כספית ללא הסכמתכם, אשר לא תימנע באופן בלתי סביר.

אתם מתחייבים לשתף פעולה באופן סביר בהגנה מפני תביעות כאמור, לרבות מסירת מסמכים רלוונטיים.

סעיף 19 – הפרדת הוראות

אם הוראה כלשהי בתנאי שירות אלה תיקבע כבלתי חוקית, בטלה או בלתי ניתנת לאכיפה, ההוראה תיאכף במידה המרבית המותרת לפי הדין החל.

החלק שאינו ניתן לאכיפה ייחשב כמופרד מתנאי שירות אלה, וקביעה כאמור לא תשפיע על תוקפן ואכיפתן של יתר ההוראות.

סעיף 20 – ויתור; ההסכם המלא

אי־מימוש או אי־אכיפה מצדנו של זכות או הוראה מתנאי שירות אלה לא ייחשבו כוויתור על אותה זכות או הוראה.

תנאי שירות אלה וכל מדיניות או כללי הפעלה המפורסמים על ידינו באתר או ביחס לשירותים מהווים את מלוא ההסכם וההבנה ביניכם לבינינו בנוגע לשימוש בשירותים, ומחליפים הסכמים, תקשורת והצעות קודמים או מקבילים, בעל פה או בכתב, המתייחסים לאותו נושא.

כל עמימות בפרשנות תנאים אלה תפורש בהתאם לדין החל.

סעיף 21 – המחאה והעברת זכויות

אין להאציל, להעביר או להמחות הסכם זה או זכויות או התחייבויות מכוח תנאים אלה ללא הסכמתנו מראש ובכתב, למעט כאשר הדין החל קובע אחרת.

ניסיון המחאה בלתי מורשה עשוי להיות בטל וחסר תוקף.

אנו רשאים להעביר, להמחות או להאציל תנאים אלה ואת זכויותינו והתחייבויותינו, ככל שהדבר מותר לפי הדין החל.

סעיף 22 – הדין החל וסמכות שיפוט

תנאי שירות אלה וכל הסכם נפרד שבמסגרתו White Lotus מספקת שירותים יהיו כפופים לדיני מדינת ישראל ויפורשו בהתאם להם.

בכפוף להוראות הדין החל ולהוראות סמכות שיפוט קוגנטיות, מחלוקות הנובעות מתנאים אלה או מהשירותים או הקשורות אליהם יהיו כפופות לסמכותם של בתי המשפט המוסמכים בישראל.

אין בסעיף זה כדי לגרוע מזכות צרכנית קוגנטית או מכללי סמכות שיפוט מחייבים החלים לפי הדין הישראלי.

סעיף 23 – כותרות

הכותרות במסמך זה נועדו לנוחות בלבד ולא יגבילו או ישפיעו בדרך אחרת על פרשנות התנאים.

סעיף 24 – שינויים בתנאי השירות

ניתן לעיין בגרסה העדכנית ביותר של תנאי השירות בכל עת בעמוד זה.

אנו שומרים לעצמנו את הזכות, בכפוף לדין החל, לעדכן, לשנות או להחליף כל חלק מתנאי שירות אלה באמצעות פרסום עדכונים ושינויים באתר.

באחריותכם לבדוק מעת לעת אם חלו שינויים באתר.

כאשר הדבר נדרש לפי דין, נודיע על שינויים מהותיים בתנאים אלה, ושינויים כאמור ייכנסו לתוקף במועד שיצוין בהודעה הרלוונטית.

המשך השימוש בשירותים או הגישה אליהם לאחר כניסת השינויים לתוקף ייחשב כהסכמה לשינויים, במידה המותרת לפי הדין החל.
